In order to compel the insurance company to respond to your claim, you require the weight of the court system behind you. An experienced lawyer is not just beneficial to maximizing your recovery – it’s essential. The insurance company has resources and expertise, and you deserve the same.

A Snapshot of the Claim Process

  • 1. Schedule a Free Consultation

    You’ll meet directly with me, and we’ll review your case together to confirm whether you have a viable legal claim. Consultations can be done in person (in the Greater Toronto Area), phone, or via Zoom.

  • 2. File a Claim

    If we determine you have a viable cause of action against the insurer, or payor of benefit, we will proceed to initiate a Statement of Claim (lawsuit) on your behalf, listing the allegations against the insurer.
    Once a claim is filed a lawyer is assigned on behalf of the insurance company. All communication in a lawsuit occurs from lawyer to lawyer – preventing the insurer from contacting you directly.

  • 3. Gather Evidence

    The next major step in a legal claim is the collection and exchange of evidence and relevant documentation and information. There are two primary methods of exchanging evidence:

    • Affidavit of Documents
    • Examination for Discovery

    The collection, analysis and presentation of evidence in support of your claim is one of my key functions in pushing your case forward to a successful resolution.

  • 4. Mediation and Negotiation

    Mediation is a process where the parties to a lawsuit meet, either in person or virtually, to negotiate a settlement of their claim. The process is overseen by a neutral third-party mediator (usually a lawyer with experience in disability law). The mediator is selected by mutual agreement.

In the rare case that a dispute cannot be resolved via agreement, the parties will proceed to Trial. A decision would then be rendered by a Judge or Jury of your peers.

Consultation is your first step

Initial consultations with me are always timely and free. It’s quick and easy to arrange a telephone call or virtual meeting, or meeting in person. During this consultation I will review all available information and provide immediate feedback on your claim. It’s also an opportunity for you to ask me questions about your case, general questions about the legal process, or about my services. During the consultation process we do not require detailed records. Should you decide to retain Bradley Legal to move forward with your claim we will request all evidence and information necessary these separately.

You will never be asked to sign a contract or retainer as a condition for consultation.
